They actually have no acting authority, they are an advisory board.
They said that they have to defend the constitution and any act against the constitution is against the law. They also mentioned the constitution again when discussing the certification of Joe Biden. So when it is revealed that, yes, it was in fact, unconstitutional to certify Biden, the Joint Chiefs of Staff just confirmed that, yes, the military will defend the constitution because they all broke the law.
