sorry but all the speculation about EO taking effect after the faux "inauguration" day seems ludicrous as do many other theories. many ideas of which sound like a terrible plan. stop assuming the timelines require use of the full 45 day clocks or that it ever required Trump to take any initial actions to initiate. broken down...

stop thinking we regular folk know when (even IF remains a question and concern frankly) the EO would have been activated with any certainty or when each report would have been delivered.

directly from the EO with emphasis in CAPS:

"Section 1. (a) NOT LATER THAN 45 DAYS AFTER THE CONCLUSION OF A UNITED STATES ELECTION, the Director of National Intelligence, in consultation with the heads of any other appropriate executive departments and agencies (agencies), shall conduct an assessment.... The Director of National Intelligence shall deliver this assessment and appropriate supporting information to the President, the Secretary of State, the Secretary of the Treasury, the Secretary of Defense, the Attorney General, and the Secretary of Homeland Security."

first thing that needs to happen legally is determine when this 45 day clock starts. it starts AFTER THE CONCLUSION OF A UNITED STATES ELECTION. that certainly wasn't November 3rd or Trump would have been declared the winner. legally this determination is ripe for a legal challenge, but for sake of discussion let's assume its "conclusion" was November 7. that would mean that the initial "assessment" (an assessment could be handwritten on one piece of paper arguably although we can assume it would be much more detailed) would be due WITHIN 45 days, or ANY TIME BY OR BEFORE December 22, meaning Ratcliffe could have conducted and delivered this assessment within 1 day by November 8 if he was able and willing. the assessment did not need to be provided only on the 45th day. it only needed to be produced WITHIN 45 days of the CONCLUSION of the election. anybody's guess when this happened.

the second 45 day clock again is WITHIN meaning it could be acted upon within 1 day or 45 days. Section 1.(b) text from EO:

"(b) WITHIN 45 days of receiving the assessment and information described in section 1(a) of this order, the Attorney General and the Secretary of Homeland Security, in consultation with the heads of any other appropriate agencies and, as appropriate, State and local officials, shall deliver to the President, the Secretary of State, the Secretary of the Treasury, and the Secretary of Defense a REPORT..."

moreover, Section 1.(d) provides that at ANY TIME someone can produce such assessment of foreign interference:

"(d) Nothing in this order shall prevent the head of any agency or any other appropriate official from tendering to the President, at ANY TIME through an appropriate channel, any analysis, information, assessment, or evaluation of foreign interference in a United States election."

then Section 1.(f) sets a timeline of NO MORE THAN 30 days for those departments to basically coordinate a plan of action. I would gather this might have been the 30 days Flynn referred to when he asked the military to stick around for 30 more/extra days:

"(f) Not later than 30 days following the date of this order, the Secretary of State, the Secretary of the Treasury, the Attorney General, the Secretary of Homeland Security, and the Director of National Intelligence shall develop a framework for the process that will be used to carry out their respective responsibilities pursuant to this order. ..."

Based on this language and logic, I'd bet my money on idea that the REPORT under Section 1.(b) was delivered per the EO to the President, the Secretary of State, the Secretary of the Treasury, and the Secretary of Defense sometime not long before the sham inauguration and the up to 30 day clock began then for action, some of which may already be happening

note that the EO once written didn't require the President to later activate it or announce it at any point because it wasn't in his control as written. it only required DNI Ratcliffe perform the assessment and deliver that assessment to the appropriate parties and let the snowball get rolling!
