hello, im watching the impeachment trial for the past 4days and i have a question on my mind on these kind of proceedings. Since im not from US, im not very familiar with legal proceedings in US so if there are GA users that are (perhaps someone who is studying law or even a lawyer) is there any kind of appeal possible for DJT team like appeal to supreme court or something like that if DJT was convicted and impeached? Would the case by over?
Edit: Thanks for all the answers made some things clear to me, going to research this a bit more.Very interesting stuff.
I would think so, because the Supreme Court has the power of 'judicial review' where it can decide if proceedings follow the Constitution or not. If the impeachment trial violated the Constitution (which it obviously did, with fabricated evidence) then I would guess it could be voided.
It violated the constitution before it started because the US Constitution requires the Chief Justice of the Supreme Court to oversee an impeachment trial and Roberts refused.
With all due respect, you're wrong. Here is what it says:
When the President of the United States is tried, the Chief Justice shall preside
Since Trump isn't the President, then the CJ does not have to preside over this trial. I'm not sure why people don't understand that as it's pretty plainly written...
Therefore it isn't an impeachment. I have already said above that Trump "supposedly" wasn't the president. I also said this impeachment trial was a charade. It's a clown show. Only a sitting president can be impeached. In an impeachment trial the CJ presides. Impeachment was the route the Founders gave us to take power away from a president. Benjamin Franklin said they gave us impeachment to prevent assassination.
