Not relevant to mask wearing at all....are you assuming that you can create a “disability” for yourself so you legally do not have to wear a mask or am I missing the point? I am not a shill but I am starting to be a little objective to some of this far reaching irrelevant data
Not so much assuming that you can create a disability but learning to use their rules against them. Their rules state that an exception must be made for people with a disability. Their rules also say medical records are confidential and free from unlawful search and seizure. Their rules also say that any business that is open to the public can not discriminate against a person because of a medical disability. Their rules further state that any business open to the public must make certain accommodations for persons with disabilities in order to serve those people.
Here's the thing. In a perfect world laws are made in good faith. That's why the officer has to have probable cause to search you because the law is neutral and assumes that people are honest and forthcoming. So in a perfect world, when a customer enters a store with a mask on the owner/employees HAVE to operate under the assumption that the unmasked patrons are law abiding citizens.
This principle works the same way as it would if a store accused you of stealing with no proof. It happened to my mother once and she sued the shit out of the store. Because they must act under good faith until they personally witness something indicating otherwise then they are forbidden from asking about your mask.
The problem is the courts are crooked as hell and probably would not find standing to file a lawsuit.
I somewhat agree with this...too many sheeple employees within stores that get power trips out of enforcing this shit...and agree with courts being corrupt..
