My take from Patel's statement that "there is no mechanism" in place, is simply that it is unprecedented and unchartered waters. There is no existing mechanism, but there never has had to be.
Also, Kash doesn't strike me as the kind of person who would speculate publicly what MIGHT happen, even if he though things might happen (aka if a mechanism had to be created).
