Remanded back to the state. The judge in the state already ruled in favor of the policy. Return to state, reaffirm in state. If appealed, reaffirm in 5th district court of appeals. Not really a "loss", just scotus re-affirming states rights, once again.
If a President can issue a "Remain in Mexico" policy through Executive Order...
Then a President can rescind a "Remain in Mexico" policy through Executive Order.
Just because I agree with Trump's policy, doesn't mean I agree that a previous President's policy can't be undone.
If that argument were to hold, then even if Trump comes back, he couldn't undo any of Biden's horrible policies without more court battles than he can manage in a 4-year term.

Which raises the question....why hasn't Biden reversed it by EO? Maybe because.....Biden isn't president?
Because Trump's Remain in Mexico was not invoked via EO, but buy agency policy.
I think that is the correct answer.
How is the case going I wonder that decides whether Biden has to digression to not detain large groups of illegals.
Last time I heard anything on that we were winning that case.
