The most positive thing I can say about her is at least she's not replacing a conservative justice, but a liberal one. I fully expect her to be more radical than her predecessor, but at least her opinions will be balanced by a fairly solid conservative (Constitutional) bloc of justices.
Is there one case where Breyer would have voted differently?
Only case I can think of is possibly Berger v. NC Conference of NAACP.
In that case, the question was whether or not North Carolina state legislators from the GOP could sue Josh Stein, the Democrat Attorney General for inadequately defending North Carolina Senate Bill 824 and its photo ID requirement for voting.
That 8-1 Yes decision may have went 7-2 otherwise.
