We have to be at war for there to be a "treason" trial held by the military. Since we aren't at war the trials will be for "espionage" which will be held in a regular federal courthouse.

I don't believed the congress declared "war", it was an "Authorization for Use of Military Force". Technically not a war but I get what you're saying...might as well be.
