He's right that they don't have different rules, but they sure do enforce them differently.
Biden's first stolen classified documents were found on Nov 2, yet Garland refused to appoint a Special Counsel, instead appointing one for Trump's 'stolen documents' on Nov 18. He only appointed Hur after classified documents were found a 4th time, all the while allowing Biden's attorneys to conduct the searches (did they even have security clearances?) instead of conducting FBI raids. Sure seems like a different enforcement of the rules to me.
