The criteria and procedure used to choose the appointee depends on the congressman and senator. Courts can't proscribe this sort of thing to the legislature. The children of admirals and generals can get appointments with the same physical and academic requirement and I think medal of honor winners' kids can get an appointment.
Hmm. I kind of wonder about that. My hubby is an Academy grad, and so is our daughter and son in law. Anyway, you do swear an oath when you enter the Academy, so maybe that has something to do with being a military member. Interesting.

They weren't part of the original suit and for some reason... the Supremes decided it might be a "national security" issue.
