They are not going to be the president.

Do you mean...
The J6ers are not like a President. A president is not to be tried in court. A president is to be tried through impeachment. They're dropping the cases against Trump because they are invalid during his presidency. J6ers do not have that distinction and can still being held in jail and/or tried in court. Is this what you meant? If so, I believe you are correct.
