Children of undocumented immigrants who are born in the U.S. will obtain what's often called "birthright citizenship." It is conferred automatically, by virtue of being born on U.S. soil. This right comes from the Fourteenth Amendment to the U.S. Constitution, BUT The Constitution protects all people living in the United States, regardless of immigration status. Most constitutional provisions apply based on personhood, not citizenship. In other words, if an individual is physically present in the US, they are entitled to the protections granted by the Constitution. But Under current federal law, undocumented immigrants remain unable to access one of the most fundamental rights contained within our Constitution: the Second Amendment right to keep and bear arms. Several undocumented immigrants have challenged the constitutionality of the federal prohibition (18 U.S.C. § 922(g)(5)(A)), resulting in a three-way circuit split on whether undocumented immigrants are protected by the Second Amendment. The Supreme Court, however, has remained silent on the issue, leaving undocumented immigrants unprotected. Not sure how some rights are given to a illegal invader and some are not. I my self feel that illegal invaders should have no rights and they should be under Military law
