I believe the good guys will win but the DS (Apple,Google, etc.) doesn't care about violating the law. If they don't lose, none of their bad acts will matter because they won't be prosecuted. If they lose, they'll be on the hook for much worse. So for the DS et al it's balls to the wall, full on scorched earth to "win at any cost".
