My position would be:

  • I am a volunteer, not an employee.
  • As a volunteer, employment policies do not apply.
  • Because a position of election worker is authorized by the State (assuming there is such a law/regulation), the laws of the State apply.
  • No State may violate my right to prohibit a search of my person, except upon a warrant signed by a judge, whereupon some individual attests under penalty of perjury that there is probable cause to believe a crime has been committed.
  • Because no warrant has been issued, and because I do not consent to a search of my person via drug test, I do not agree to any drug test as a condition of my volunteer status of election worker.
  • Furthermore, coercing me or penalizing me, including refusing my volunteer status as election worker, is a felony under federal law, 18 USC 241, Conspiracy Against Rights:

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State ... in the free exercise or enjoyment of any right or privilege secured to him by the Constitution ... of the United States, or because of his having so exercised the same ... They shall be fined under this title or imprisoned not more than ten years, or both;

  • In addition to felony charges brought against you, you can be sued in your personal capacity for violating my rights, 42 USC 1983, Deprivation of Rights:

Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State ... subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution ... shall be liable to the party injured in an action at law, suit in equity

I recently had a traffic ticket dismissed because I challenged the authority of the court, and they couldn't figure out what to do other than dismiss. Note: They will NEVER agree that you are right, but in the end they should agree to do what you want, which in this case is be a volunteer election worker.

NOTE: If they fight back, there will come a point where they will make a claim that a drug test is "necessary" for some [arbitrary and undefined] reason. At that point, you tell them they must provide proof that there have been situations in the past were a non-drug tested volunteer election worker has caused harm to someone. They won't be able to do it, which proves their drug test is arbitrary and capritious, which means they are violating your rights.
