OK. NOW I think I understand what all the private sessions were about.

Trump's lawyers filed their long-promised mistrial motion, leaning into attacks on the judge and his law clerk as "biased."

The motion cites her name eight times. The phrase "Principal Law Clerk" appears 44 times.

Both Trump and his lawyers are gagged from going after the clerk, but the judge gave some latitude for their mistrial motion, a topic that lawyer Alina Habba indicated the defense would invoke "delicately."

Looks like Engoron gets to decide.

It is highly unlikely that Engoron will declare a mistrial, given his earlier fraud findings and defense of his law clerk's conduct.

Yesterday there were private talks between the lawyers and then the lawyers for each side and the judge. There were rumors of a settlement, but maybe it was about this.

Apparently the settlement rumor started with Trump himself. He mentioned the settlement conference on Truth social. yesterday

For context, here's what Trump said on Monday:

"He asked me to settle for a MUCH LOWER AMOUNT, at a settlement conference, but I said NO, I DID NOTHING WRONG!"

Look up Trump Organization II LLC.

He tried to set that up in Delaware the day the lawsuit against him in New York came out. The New York AG went to court and got an injunction prohibiting him from moving any assets to new corporations.

It's a civil suit. There's no prosecutors.

I think any party could suggest it.

It’s hard to come to any useful conclusions without sauce.

It's basically reporters covering the trial and so far it's just talk in the courthouse....outside the courtroom Alina Habba is talking mistrial.

it sounds like it is the NY AG’s office that is seeking a settlement.

See my other post. The AG's office already won a gigantic part of the case before trial and are seeking a huge amount of $$$. So there is incentive for Trump to settle. Trump tried to settle this case back in September 2022, right befor the lawsuit was filed the made a last minute pitch to the NY AG.

In the lawsuit the state asked for several remedies.

These the judge ruled on before trial

Cancellation of Trump’s NY business certificates.
All of Trump’s many LLCs ultimately roll up to just a couple, so this affects Mar a Lago and the Chicago Hotel and golf courses outside of NY. This is on appeal.

But my understanding of this is that it would be like a bankruptcy, the businesses would be dissolved, creditors paid off, any remaining money would go to Trump

Fulton County District Attorney Fani Willis' office is seeking an emergency protective order after portions of videos from key witnesses in her election interference case against former President Donald Trump and others were leaked to two news outlets.

"The release of these confidential video recordings is clearly intended to intimidate witnesses in this case, subjecting them to harassment and threats prior to trial," the DA's office said in a court filing Tuesday after portions of the videotaped statements of lawyers Jenna Ellis, Sidney Powell and Kenneth Chesebro and bail bondsman Scott Hall were made public.

Judge Scott McAfee scheduled a hearing on the emergency motion for Wednesday.

In addition to the Powell and Jenna Ellis videos, the Post got proffer videos from the other two defendants.

Although some of the recordings were garbled, the portions of the four statements that The Post was able to review — from Ellis, lawyers Kenneth Chesebro and Sidney Powell, and Georgia bail bondsman Scott Hall — offered many previously undisclosed details about the effort by Trump and his allies to reverse his defeat.

Chesebro disclosed in his recorded statement that at a previously unreported White House meeting, he briefed Trump on election challenges in Arizona and summarized a memo in which he offered advice on assembling alternate slates of electors in key battlegrounds to cast ballots for Trump despite Biden’s victories in those states. Chesebro’s recollection could provide evidence that Trump was aware of the elector plan.

The audible portions of the Fulton recordings reviewed by The Post do not appear to directly implicate Trump. At one point in Powell’s interview, she said Trump really believed he had won — a statement that could help his defense. But Powell also said that Giuliani spoke of a plan to gain access to voting equipment at a Dec. 18, 2020, meeting with Trump and others in the Oval Office. And Hall appeared to implicate another defendant, lawyer Robert Cheeley, describing Cheeley as part of the “brain trust” planning the Coffee County scheme. Giuliani spokesman Ted Goodman, asked to comment on the recordings, called the Fulton investigation a “farce” that should be dismissed immediately. A lawyer for Cheeley declined to comment.

Given that they both are testifying in this case, this information would be turned over to the defense as part of the discovery. They plead guilty last month, so all the remaining defendants probably have these videos by now.

My guess is defense counsel for someone.

It's important to note that mistrials are not declared lightly, and judges carefully consider the circumstances before making such a decision. After a mistrial is declared, the case may be retried with a new jury or under different circumstances. The decision to grant a mistrial is within the discretion of the presiding judge.

This is why I think they chose a different route.

I don't think this is going to happen.

They initially said they were filing this last week.

The did ask the judge for a directed verdict.....which is saying the state didn't prove their case, so there's no need for the defense to go on. The Judge said the trial would continue today and it did.

They they claimed they were going to finally for mistrial immediately, but they didn't.

But they did do something else.

Elise Stefanik filed a an Ethics complaint to the New York State Commission on Judicial Conduct.

Elise Stefanik is not a lawyer, but her letter reads like a legal brief. So people thought that they put the complaints in here
