This is good analysis. She’s making statements of the law. Laying out the standards that her statements must be judged by. People will run with some of the arguments that she makes from case law she is citing but these are the arguments made in these types of cases. The case law she cited is probably cited in 90+% of defamation suits as part of the defense set up. But MSM and liberal nitwits will either not know or intentionally not tell their viewers or readers that.
Also, importantly, truth is an absolute defense in a defamation suit. The first step in the analysis of a defamatory statement is whether the statement is true. If so, end of analysis. Maybe Sidney has the receipts. That would be awesome.
Additionally, even if she has the proof, her attorneys would still lay out these legal arguments as part of the case. You cannot argue on appeal, something that you did not argue in the underlying case, and the court cannot base a ruling on something that you did not plead, usually. We’ve all seen judges go just make up law to get the result they want....

If you read the book it’s obvious that Mario Puzo knew how disgusting and fucked up hollywood was. It’s also possible that what is now known as XVIII Airborne Corps was once the 7th Virginia Volunteer Infantry or some such and it and has evolved into an Airborne Corps.
