The date is when Trump is the president and not exactly sure if RICO applies when the act is done during presidency.

The DOJ policy is they don't charge sitting presidents. That's at the federal level. Don't know how it would work for the state, but the DOJ policy is that you can charge a former president for crimes committed while in office.

This policy has never gone to the Supreme Court and it dates back to Watergate, when both the President and Vice President were in danger of getting indicted.
