Potus is still potus. He is the commander if the military. Lincoln didn't step out when he declared martial law. Also I think some people are mixing insurrection act and martial law. He will not be suspending habeas corpus. We still have an active constitution. Only those taken and charged with treason will be tried in military tribunal
