Can you start another company that splits the employees?
You have company A with 200+ employees so you split that into companies A,B,C.
company A can remain in control of B and C.
Employees just get "reallocated" across A, B, and C as appropriate...
Then they just lower the number.
Stop capitulating or die.
Now I don't disagree with you, but isn't what I described the kind of bullshit these mother fuckers do to keep ticking?
If you ask me, running your business as a corporation is already capitulation. You're just "playing ball".
Don't get me wrong, I prefer to stand my ground on shit where I can - this is a case of 200+ people who might not know better and trying to help them out. Maybe another solution is to totally restructure and just make everyone contractors where you come up with an independent health insurance pool. Give all your employees good contacts and poof your company is down to the minimum employees and you're managing contractors that you're very benevolent to.
It's a gray world we're in, you play or be played. Right now, having 100 or more employees puts you in a situation of getting played and I just described a solution out.
What you're getting at is just stand there and get steam rolled. I'm suggesting you make a pivot, if it makes sense. It might even wind up being advantageous. At least figure it out in case standing your ground isn't going so well ....
I wonder if there's even a way to figure out how to tax deduct the fuggen "fine"...
