Everyone is innocent until proven guilty by the law here. Bail is supposed to be an assurance that you show up to court, not an indication of your guilt or innocence. So simple answer is yes, everyone should get a hearing or due process for bail.

You have to understand until you are found guilty you have the assumption of innocence. In cases like these it's tempting to throw that right away but really your losing the baby with the bath water.
