My hunch?
Elon knew of this from the get-go. For reasons known only to him, he chose to proceed regardless. From my naive perspective, it surely does seem that his staff IS capable of rewriting/overwriting prior code in order to effect the many improvements that anyone paying attention (by reading Elon's daily tweets) can be aware of. Further, I conjecture that HE knew that he knew about the impropriety, BUT "Twitter Inc." did NOT know that he knew and/or COULD know; this I would call a Genius Trap ... by (now) owning Twitter, he can go litigious on the former owner's/owners' sorry asses, and thereby FURTHER expose their Evil Doings.
YMMV, I could be all wrong about this, etc. etc. etc.
