Since the Constitution is tossed I guess it doesn't matter, but supposedly humans have the inalienable right to life, liberty and the pursuit of happiness. Confiscation of property would seem to conflict with that.

And what if I refuse to surrender my third parcel of land, or my second story apartment to the benevolent state? Will you send men with guns to execute me if I don't comply? Won't that violate my human rights? And if you're not going to send men with guns to enforce your edicts, why should I comply?

No it wouldn't. It is the confiscation of EXCESS property.

Here is the beauty of the situation. We merely need to switch ownership of the property in the property database. Then you lose all legal rights over said property.
