Daniel Penny did not kill Jordan Neely.

Jordan Neely died as the result of misfeasance on the part of the NYPD responders who "didn't want to touch him". He died after he eventually got to the ER from a combination of a drug overdose and a Sickle Cell Anemia crisis.
