So maybe that's it.

POTUS shuts down the gov because he didn't sign the spending bill.

Pence can't sign it because he's just temp-POTUS.

Gov stays shut down so arrests can be made- Congress CAN be arrested on BREAK.

If Congress is not in session, the President can appoint a temporary or interim Justice, who will sit through the next Congress (ie from now until January 2023). No hoops, no hearings, no approvals. Completely bypasses the Legislative branch.
