  2. SCOTUS denies because they are instructed to by military, which would implicate their own guilt, I'm not sure I buy that.

1 serves as acting in their best interests because we are not in control, 2 would be them acting against their own best interests because we are in control. If military moves in, they are outed as working against the will of the people and even as outright traitors..

At this point SCOTUS having an inkling of military control or participation, would mean they would likely have accepted a few cases as noted, to slow walk or debunk to give them legitimacy. Them not doing so sort of limits the possibilities here...
