He believed it would set a bad precedent to remove the rights of states to certify elections, and the evidence of fraud was not up for debate in the Senate. (Nor was sending it back to the states, nor did he have a House member willing to pair up with him to object , any one of these would have been a way to accomplish the goal of denying certification Constitutionally.)
