As far as Constitution requirements for treason, there are all sorts of ways you can levy war against a nation - psychological subversion, economically etc. Doesn't have to be armed physical confrontation. These people are always saying they want to destroy the US (and muh capitalism) which is essentially undermining and engaging in war against the State. Adhering to the enemies of the US well you could make an argument that working with socialist nations around the world who want to see world communism are enemies of the US even if no war has been declared.

If that Chinese defector has info on people selling state secrets and research to China that undermines the US that would be treason and worthy of hanging imo. And I would say China is totally engaged in warfare against the US and the world.

Those leaked vids from China showing people dropping dead in the street from Covid (which happened in no other country) suggests they were deliberately making it seem as if that was going to happen elsewhere causing world economies to shutdown which is definitely considered an act of war, and they must have been working with people in the West who promoted this a likely (so-called experts and media).

Bastards are planning to keep it going into Winter lockdowns, but the Dong guy might just save the day. It's significant the DIA wouldn't let the State Department or CIA/FBI know suggesting Chinese assets embedded in the civilian Intelligence community. Some could be charged under the Espionage Act - I think that also carries the death penalty - didn't they execute the Rosenbergs under that Act?

Also don't forget the US is still on a war footing since 9/11 so any acts designed to weaken and subvert the Republic, and working with foreign countries against the US interests would be an attack during a state of war. Rules are different during a state of war.
