This really is a tremendous victory! The Atlantic had an article in September declaring Missouri the new frontline in the covid culture wars, and it is shaping up to be truly so. I'm impressed with what is going on in Missouri. Between this court case, the new legislative law I've explained, and the MO governor's recent order prohibiting all state agency's from aiding in any way with enforcing federal vaccine mandates, Missouri is becoming one of the most protected areas in the country.
There's an extra great catch here, too. Because the court case was brought against the state health department, the Missouri AG was obliged to defend the case. But because the MO AG hates such mandates and has been fighting every one of them in other jurisdictions, he no doubt agrees with the court's decision. So, the state being the sole defendant, this judgment will stand unchallenged because the AG has signaled he has no intention of appealing it! Ha ha!
And one of the plaintiffs came out today on twitter to announce that his attorneys had advised the plaintiffs to keep the case a secret from when it was filed in 2020. So it stayed under the public radar until now. So, kaboom! This is the sort of thing that could catch on as a the model for future cases everywhere. The case does cite three cases from WI, MI and PA, but those cases are all targeted against the governors and their health orders. This is the first case I know of that eviscerates state administrative agency authority to delegate discretion to state and local health agencies for promulgating health mandates and orders.
