The story I read whe it broke is that his BAC was .08, which is the legal limit, and about 3 glasses of wine for an elderly man of his size. I don't believe he would have been booked if thar is what it was. He killed his brother drunk driving, but thar was decades ago and won't be a factor, but I think he has had other duis in the past ten years which will make for a harser penalty (or would for any plebs in that situation ).
