I haven't read the opinion, but if they are saying it is a violation of the Wisconsin Constitution, and that is why they are "unlawful" (not illegal), then those ballots in 2020 did not count. If those were enough to change the election, then Wisconsin's electoral votes are not valid.

If so, then Wisconsin's legislature is in a position where they must decertify the 2020 election results.

Ex post facto law is making a law (by legislature) that imposes some requirement or punishment and applies retroactively. A court decision saying something is unconstitutional or was a violation of law, means that the act committed was not valid back when it happened, and was therefore a violation of law.

You could even say that, as a matter of law, the act did not happen. In this case, those votes were never cast. Therefore, they must be excluded from the total of the votes that were cast.
