I would like to add one thing. I was denied the CVR because it wasn't produced in the normal line of county business and therefore there no obligation to produce it now.
After three attempts, my county is now "working with the vendor" to get me the data.
An excerpt from my latest request:
Pursuant to the Freedom of Information Act (FOIA), 5 U.S.C. §552, the Privacy Act 5 U.S.C. §552(a) and [State] Public Records Act § [#] Et Seq, I am requesting, by way of this form, an opportunity to either inspect or receive all data produced by all ballot tabulation equipment for [my] County for the year of 2020, including all data currently residing within ballot tabulation equipment and any backups or copies made of data produced by ballot tabulation equipment. Please note that while Cast Vote Records are a convenient way of exporting this data, Cast Vote Records are not requested. Only the data already produced by the ballot tabulation equipment is requested.
I don't know what they'll give me, but I wasn't flat out denied finally! I hope this helps others break through the denials. Also, I know nothing about anything - this is just my experience so far.
