The records are deleted by law. There is no way you could spin that as "willful destruction of evidence." No competent lawyer wouldn't immediately cite the state or federal statute on cross, and nullify the point.
I do believe the official records will be deleted. That will be legal. The question is whether they are backed up. I'm quite certain NSA has such a backup in one of their server farms. More to the point, I think private contractors also have archived all of those records, since they were publicly available and downloadable. The details needed to prove fraud will go beyond the official results though, and those user logs, etc are long gone. If this is part of any "plan," we'd better hope they don't need this evidence to prove their case.
Edit: While we're dealing in Q theories, the Red Castle background on that speech we just watched caught my eye and got me thinking. Not sure yet if it's anything or if so, what. What I do know is that these backdrops are meticulously chosen and the red color is a powerful psychological driver. I strongly suspect multiple messages were sent if I could bring myself to listen to this schmuck read the script he was handed.
