Agreed. And that's why I think they've struggled so hard with figuring that out. They've focused so much on what Trump did or didn't do. They've been so caught up worried about him that they've been distracted from what was being done by Pence, Pompeo, Miller etc.

I think we're both on the same wavelength, re: at the very least Trump wasn't exercising presidential powers on Jan 6. I can see how that would protect Trump from having records of his doings. Granted, it also means he has no Constitutional presidential authority to do anything a la ordering military action.

See I'm less interested in what was going on with Trump. I'm more interested in the others, Pence in particular. If Trump was 25th'd by others, OR BY HIMSELF, then Pence is Acting POTUS. Which means he's got control over the military. It also means that the entire Joint Session and counting process was invalid under the Constitution. The President of the Senate alone has the authority to open the purported Electoral certificates and (with the Congress as witnesses) count the votes. Can the Acting POTUS also serve simultaneously as the President of the Senate (typically the VP)? I don't think so and can't find any precedent to the contrary, though we do have interesting cases like in the 1876 fiasco, with the VP being vacant, there was still an Acting President of the Senate. But imagine the Acting POTUS, let alone a candidate and party to ongoing disputes over Electoral appointments, presiding over the body [unlawfully] claiming for itself to be the final authority on such adjudication, while also having full authority over the military to shut it down...

It would certainly seem to be a conflict of interest and a violation of the separation of powers, but think of all the possibilities...

I've touched on the possibility, nay the likelihood that Pence was Acting POTUS on Jan 20, Jan 6, and possibly even as far back as early Oct when Trump went to Walter Reed. Some observations by u/Norman_F_Dixon got me down that road, and u/CHAOS_ACTUAL has also been interested about the speculation, and particularly NFD's focus on that Oct 5th return to the Executive Mansion and the unusual helicopter salute. If true, it would certainly help explain some inconsistencies with the subsequent events and comments like those of Miller and Pence at the Dec Space Force anniversary celebration, as well as other instances of Miller and Pence appearing to break the 4th wall.

In any case, lots of things don't really seem to be as they appear...

Consider this... Trust Grassley. Trust Kansas. What if that was Piglosi in the ambulance? What if Trump AND Pence 25th'd themselves? With Nancy out of action and no Speaker, next down is Grassley to Act. He 25ths himself. Next down is Sec of State Pompeo. Granted as I've argued before, neither Speaker nor President Pro Tempore are eligible. Say Grassley agreed with this correct view of the Constitution and supported the lawful successor behind Pence, Pompeo? In either scenario, only obstical is Nancy. But with her in custody... 🍿
