As for researching what he says. US Law (and orders) derive from the Constitution. The language of Constitution is quite clear

The Constitution provides: “The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States . . . .” U.S. Const. art. I, § 2,cl. 1.

This makes Biden as president the Commander in Chief.

For anyone who needs more evidence ever since Watergate, the DOJ has had a policy of not indicting sitting president.
