When the commies say what they say about only white people being able to be “racist”, they’re actually correct, legally.

The case Harris v. Allstate Insurance Company in the United States District Court, Southern District of New York lays out the elements to establish a Section 1981 claim. Plaintiff must allege facts to support the following elements:

  • The plaintiff is a member of racial minority;
  • The defendant intended to discriminate against plaintiff on the basis of race; and
  • The discrimination concerned one or more of the activities enumerated in § 1981, such as making and enforcing contracts, suing and being sued, or giving evidence.
