Oh no it’s been conferenced and/or heard several times brought in and out. No Supreme Court Case is only just heard once unless they specifically deny an appeal. Most cases are sent back for technical reasons and then must be rescheduled, conferenced, or heard again. It happens way more than you think. Just because you hear about a 1 win or 1 denial does not mean that was the only time the case went through. It’s the same in every Federal lower courts and State Supreme Courts. I’ve spent 20 years in and out of the court room for people and for the government. The media doesn’t talk about all the times cases come and go before SCOTUS.

The Brunson Case hasn’t even been heard. It was declined on the same day as a pack of other cases for one technical reason or another. But it was provided an appeal. So they fix what ever the court declined it on, and bring it back. I bet this happens 1-2 more times before they actually hear it for the public/media, or deny it again for an appeal or deny it permanently.
