It occurred to me that this didn't matter because he plans to invoke it before the deadline. Additionally, the porkulus red lined tems that can be potentially ignored by Congress may either be moot because Congress itself will take a major hit before then or it is designed to be swamp draining phase 2 during his 2nd term where they follow the money.
