Without it, criminals would simply be turned over to the already-corrupt courts. The military has to arrest AND prosecute.

The definition is vague, so even someone that's "linked" to a criminal can be designated an enemy combatant. The description I saw talked about how, let's say you donated money to an orphanage in Afghanistan, and it turned out that someone working there was the brother's cousin's sister of a suspected terrorist. You, by donating money, could be designated an enemy combatant and thus possibly sent to Gitmo where they could legally use torture to extract a confession out of you, guilty or not. This is what was done after 9/11, and this is why it's been controversial.
