I think OP is asking about the ceremony involved in the inauguration. My take is, that by law, Biden is 'president' at noon on the 20th, regardless of any dog faced pony show. Though the constitution requires an oath, there are no specifics in law as to when it must be sworn, who administers it or who witnesses it.

What might be in doubt now, is what exactly Biden becomes president of.
