A lawfag will know more/correct, but as far I understand, these cases are taken up in Federal Districts when they're challenged by State AGs or a federal judge can issue an injunction outright to challenge the constitutionality of whatever they're objecting to.
Some cases need an aggrieved party, others (especially if the judge is activistic) are plainly unconstitutional and will be acted upon by a judge themself.
If I recall, Obama era judges had a field day with Trump starting out, challenging every EO he did.
