So it WAS illegal during the past election? That's all that should matter. They broke the rules.

None of that type of ballots should have been counted. However, i’m sure they still counted those type of ballots to get Biden‘s numbers up. Just because you’re not allowed to do it doesn’t mean that they didn’t do it
