What happens if Trump really isn't a private citizen and was sworn in via a secret ceremony by Justice Thomas at the same time Biden was sworn in at DC? That argument has been tossed out here more than once. The 'impeachment is invalid' argument would fail. Maybe that's why Trump is insisting on a trial on the 'I didn't instigate the riots' and election fraud evidence.
