You are not correct that the machines are the property of the state. They get a license to use the code that is supposedly a "trade secret" of Dominion. I can't remember who actually owns the physical machines themselves, but the code is in machine language, not regular code.
Because they claim trade secrets, that's how they get protective orders entered in all of the law suits and how they keep computer geek-fags from examining their code.
