Not so much assuming that you can create a disability but learning to use their rules against them. Their rules state that an exception must be made for people with a disability. Their rules also say medical records are confidential and free from unlawful search and seizure. Their rules also say that any business that is open to the public can not discriminate against a person because of a medical disability. Their rules further state that any business open to the public must make certain accommodations for persons with disabilities in order to serve those people.
Here's the thing. In a perfect world laws are made in good faith. That's why the officer has to have probable cause to search you because the law is neutral and assumes that people are honest and forthcoming. So in a perfect world, when a customer enters a store with a mask on the owner/employees HAVE to operate under the assumption that the unmasked patrons are law abiding citizens.
This principle works the same way as it would if a store accused you of stealing with no proof. It happened to my mother once and she sued the shit out of the store. Because they must act under good faith until they personally witness something indicating otherwise then they are forbidden from asking about your mask.
The problem is the courts are crooked as hell and probably would not find standing to file a lawsuit.
I somewhat agree with this...too many sheeple employees within stores that get power trips out of enforcing this shit...and agree with courts being corrupt..
How so? Have there been any presidencies set in court yet? Believing they would or would not apply is simply opinion at this point. While I’m not agreeing or disagreeing I can factually say that many box stores have pulled back the idea of enforcement based on the religious rights idea. They know that in many areas “social stigma” will police many, but also realize that they have to stay neutral when challenged for fear of potential suit and vulnerability.
I've actually spoke with a lawyer about this and had a notarized copy of religious belief made for my employer. Employers have to honor the religious exemption but in Virginia the governor's mandate does not offer an exemption for religious purposes to businesses so they do not have to honor my religious exemption.
Now this is where it gets tricky ... I have tried four different doctors and I happen to have a nasal deformity that restricts airflow and as a result I have no sense of smell but doctor's will not recommend not wearing a mask or they simply tell you that if the mask have negative affects, don't wear it.
So what is a disability?

Well my severe PATRIOTITUS prevents me from being physically capable of putting a mask on. Call it a "mental condition" if it makes you feel better but there's my disability.
I know my rights still won’t detract from me being refused service or potentially arrested for “public misconduct” there are laws that defend us however there are also laws that protect the establishment
Just a suggestion ... quit living in fear. Take the mask off and you'll notice the gleam of admiration from everybody else and occasionally others will join you. Since the pandemic I've worn a mask on two occasion (once to vote and once to visit my mother in the hospital), I grocery shop (even went in Walmart once), I work, I participate in life on a daily basis and there have been two times I hadn't been able to go into a store because of it.
The federal law is attempting to be altered to change this...congrats on your little victories but you alone walking around handing cards to sheeple won’t do a damn thing
