Its not. As is par for the course around here, most people on here don't know what the fuck they are talking about. HIPAA applies to entities that provide medical care, and entities that are contracted by them to provide services. It doesn't apply to anyone else, and does not make it illegal to ask you for a medical history.
You’re right on this. It’s only a potential hipaa violation if someone else shares your medical information without your consent (and not even always then). This is a bad idea, but not illegal on its own.
But what about a refusal of service based on medical documentation?
I understand that businesses typically reserve the right to refuse service to anyone, but doing so based on medical records sounds like it may be illegal.
