It would need to be decided by the Supreme Court... and our SCOTUS would continue to ignore the evidence and likely not even hear the case.

Our military and SCOTUS are too busy playing with rainbow colored dildos.

SCOTUS cannot rule in this, they have no standing. SCOTUS does not rule on acts of war committed on USA, military law takes over.
