Playing Devil’s Advocate here for a minute, but if 230 were repealed yesterday, wouldn’t a lot of the comments made on TdW and GAW become Plaintiff’s Exhibits 1 thru 300? I thought that was why Trump backed off on it, after he made a big fuss about repealing it. His new platform would be subject to the same content liabilities as twatter and the like. And what’s to stop shills from the left coming and planting crap on our sites to get these sites into perpetual litigation? Spec: I don’t have any good solutions. Just complaining again.
Clarence Thomas said that the FCC should regulate under a common carrier rule. It's unclear if the FCC could just regulate some firms like this, they would have to regulate everyone. That's very dangerous to give the government so much power imho.
Note that Kavanaugh, under a ruling when was in the DC court, said that the FCC couldn't even regulate broadband under common carrier rules.
I think the only way to reasonable reform is not through FCC but by congress. I think a lot of people agree that reform needs to happen, just not under the Telecommunications Act.
