Not to dismiss your other points, because they are in fact valid, but no you cannot patent an idea. Conceptual patents are meaningless and hold no weight whatsoever.

What do you think a person is patenting? They are patenting their idea. If they are smart they have a working prototype because it makes patenting their future developments or tweaks much easier.
