The Court cannot find, as a matter of law, Defendants have acted within the authority given to them by the legislature when enacting face-covering requirements.”
I live in Williamson County TN and I received an email regarding this from the district communications directory where she states:
"Here are the facts:
A Williamson County judge dismissed all claims against the Williamson County Board of Education related to wearing masks in Williamson County Schools.
Because of the ruling, the mask mandate remains in effect."
I would like to read the actual judge's ruling for myself. Anyone have any tips on how to read the ruling?
I read it and that was the only provision that was granted but overall the case was dismissed and summary granted in favor of the school board. While the court was not convinced the school board had the authority, they basically don't believe they over stepped and can continue requiring the masks.
This is what I don't get... the courts say the board has no authority. Yet they are "requiring" masks. Essentially the board is bullying these children into compliance, with no legal authority whatsoever.
I know. I don't understand it either. I am in Kansas and am part of a group fighting it. Serveral families have had their case with the judge and while the judge is sympathetic, he still rules in favor of the school board. They filed a class action lawsuit that the school board got pushed to federal court to delay it.
