No that it matters much.

First, if the Biden Administration is found to be illegitimate (which it will be), Garland is therefore a illegal placement and any orders under him are null and void.

Secondly, the DOJ guidelines do NOT apply to military procedures for treason as it does not fall under civil jurisdiction.
